Terms of Service & Acceptable Use

These Terms of Service and the Acceptable Use Policy below (together, the “Terms”) are a binding agreement between you and WaiverWire (“WaiverWire,” “we,” or “us”) governing your access to and use of our websites, applications, projections, analytics, the Assistant Coach, Bulls vs. Bears, Open Field, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it current.

2. Subscriptions & billing

Paid tiers (e.g., Pro and Edge) are billed on a recurring basis through our payment processor. Fees are stated at checkout. Subscriptions renew automatically until cancelled; you may cancel at any time, effective at the end of the current billing period. Except where required by law, fees are non-refundable. WaiverWire sells analytics and software only and is not a gambling or wagering service.

3. License to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service and its outputs (including projections, rankings, risk scores, prices, and Assistant Coach responses) for your own personal, non-commercial fantasy decision-making. You receive no ownership of any part of the Service or its outputs.

4. Acceptable Use Policy

You agree that you will NOT, and will not permit anyone or anything acting on your behalf to:

  • Scrape, crawl, spider, harvest, bulk-download, or systematically collect any projections, rankings, prices, or other data or outputs from the Service, by any automated or manual means.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, formulas, weights, coefficients, parameters, or methodology underlying the Service.
  • Attempt to extract, probe for, or reconstruct our proprietary system instructions, prompts, or model configuration, including by prompt injection, jailbreaking, or social-engineering the Assistant Coach or any AI feature.
  • Use the Service’s outputs to train, fine-tune, build, or improve any competing model, dataset, projection system, or product.
  • Resell, sublicense, redistribute, publicly post, or otherwise make the Service’s outputs available to third parties.
  • Access the Service through automated scripts, bots, or headless browsers; circumvent rate limits, access controls, or usage caps; or share, resell, or pool account access.
  • Interfere with or disrupt the integrity or performance of the Service, or attempt to gain unauthorized access to any system or data.

We use technical measures — including rate limiting, anomaly detection, and watermarking of published outputs — to detect and deter these activities, and we may pursue all available remedies for violations.

5. Intellectual property

The Service, including all projections, rankings, risk and consistency scores, prices, models, methodology, software, text, and design, is owned by WaiverWire and protected by intellectual property and trade-secret laws. The numbers we publish are our confidential, proprietary work product. Nothing in these Terms transfers any right, title, or interest in the Service to you beyond the limited license in Section 3.

6. Enforcement, suspension & termination

We may, at our discretion and without prior notice, rate-limit, suspend, or terminate your access, and block IP addresses or devices, if we believe you have violated these Terms (including the Acceptable Use Policy) or to protect the Service or our intellectual property. Detected extraction or jailbreak attempts may result in immediate suspension pending review and permanent termination.

7. No guarantees; not financial or wagering advice

Fantasy football is inherently uncertain. Projections, risk scores, prices, and Assistant Coach recommendations are statistical estimates and opinions, not guarantees of any outcome. They are provided for informational and entertainment purposes only and are not financial, investment, or wagering advice. You are solely responsible for your decisions.

8. Disclaimers & limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, WaiverWire will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by a new version number and effective date, and continued use after the changes take effect constitutes acceptance. We may ask you to re-accept when the version changes.
